ART Reviews Appeals

If your Australian visa application has been refused or your visa has been cancelled, you may have the right to apply for a review by the Administrative Review Tribunal (ART).

The ART is an independent tribunal that reviews certain decisions made by the Department of Home Affairs. It does not make a new visa application but reviews whether the original decision was made correctly based on the law and the evidence available.

In many migration matters, an application for review must be lodged within 28 days of the date of the decision. However, the review period varies depending on the type of visa and the decision made. It is therefore important to seek advice as soon as possible after receiving a refusal or cancellation decision, as strict time limits apply.

- Set Aside the decision and substitute a new decision, where the Tribunal has the power to do so.

- Remit the matter to the Department of Home Affairs for reconsideration in accordance with the Tribunal’s directions or findings.

- In some circumstances, the review application may also be dismissed or withdrawn.
