Ministerial Intervention is an exceptional process that allows the Minister for Immigration, Citizenship and Multicultural Affairs to consider granting a visa where all available visa options have been exhausted and there are unique or exceptional circumstances that justify intervention.
It is important to understand that Ministerial Intervention is not an appeal and is not available in every case. The Minister is not required to consider every request, and only a small number of cases are selected for intervention each year. Requests are assessed in accordance with the Ministerial Guidelines.
Who May Be Eligible?
A request for Ministerial Intervention may be appropriate where:
- You have exhausted your merits review rights, including an ART review where applicable.
- There are unique, exceptional or compelling circumstances that are not adequately addressed by the migration legislation.
- There are strong humanitarian, compassionate or public interest considerations.
- There are other exceptional factors that may justify the Minister considering your case.
Every matter is assessed on its own individual facts, and eligibility depends on the applicable Ministerial Guidelines.
Our Process
Our team will:
- Assess whether your matter may be suitable for Ministerial Intervention.
- Review your immigration history and previous decisions.
- Identify the exceptional circumstances that support your request.
- Prepare a detailed submission addressing the relevant Ministerial Guidelines.
- Gather and organise supporting evidence.
- Lodge the request and provide ongoing assistance where required.
Why Choose Us?
We have significant experience assisting clients with complex immigration matters, including requests for Ministerial Intervention. We carefully assess each case, provide honest advice regarding suitability, and prepare comprehensive submissions supported by relevant evidence.
As every case is different, we focus on presenting each client’s circumstances clearly, professionally and in accordance with the applicable Ministerial Guidelines.
Please note: A request for Ministerial Intervention is entirely discretionary. Lodging a request does not guarantee that the Minister will consider the matter or grant a visa. Each request is assessed individually based on its own merits and the applicable Ministerial Guidelines.
